LIMITED ENGINE WARRANTY

This limited engine warranty is made to you as proof of our faith in the quality of our materials and service. This warranty protects you, but not any subsequent owner of the vehicle described below, during the warranty period which begins the date of shipment of the engine and expires on the earlier (a) 24 months after the Shipment Date and (b) the operation of the engine for 24,000 miles.

What is Covered

This warranty covers all defects in material and workmanship which appear under normal operating conditions during the warranty period, provided that you fulfill your obligations under this warranty and notify us of the defect in writing prior to the expiration of the warranty period. Engine components furnished by us, but manufactured or remanufactured by others, are covered by the original manufacturer's warranty and we are not liable for any defects in these parts. This warranty also does not cover, and we are not liable for, any defects in the crankshafts used in the Ford 330, 361, and 390 engines, or in the 173 General Motors and 1.6 Mazda engines. This warranty also does not cover, and we are not liable for, any oil leaks of any nature arising from any part of the engine, occurring after the first year or 12,000 miles.

What Are your Responsibilities

In order to maintain this warranty in full force and effect, you must (a) have the engine installed by a professional mechanic, (b) prevent the engine from being subjected to misuse (such as over-heating or oil starvation), accident, overloading, alteration or modification (including the installation of performance parts or accessories), (c) no later than 500 miles after its installation, present the engine to us for an oil change, which will be performed at no charge to you if the engine was installed by us, (d) cause all manufacturer recommended service and maintenance to performed on a timely basis by qualified mechanics, including but not limited to the changing of the engine fluids on the earlier of every 3,000 miles or three months, (e) the payment of a $50 deductible for every warranty claim made after the first year or 12,000 miles, and (f) providing, with all written notices of claims under this limited engine warranty, adequate proof of the performance of all manufacturer-recommended service and maintenance, including proof of the performance of the above-referenced oil changes.

What We Will Do If the Engine Malfunctions

If during the warranty period, we receive a written notice of a claim covered by this warranty and one of our agents confirms to his reasonable satisfaction that the engine is defective, we will repair or replace the engine, in whole or in part. Although you must pay all charges incurred to transport the engine to us for examination, we will reimburse you the reasonable cost of this transportation if the malfunction is determined to be covered by this warranty. This remedy is your sole and exclusive remedy for a breach of this warranty, and we will in no event be liable for any consequential or special damages.

How to Obtain Warranty Services

If your engine is not working properly, please call us immediately and arrange for us to examine the engine. We will not reimburse you for any warranty service performed by any other person, unless we authorize the service in writing prior to its performance. All warranty service performed by persons other than us must be performed by a professional mechanic only after consultation with us as to the scope of work to be performed. Reimbursement will be based on the actual cost of all materials used and the time schedules published in the most recent edition of Chiltion's Flat Rate Manual at a labor rate of $25 per hour. Our maximum liability for labor charges is $200.

Limitation of Implied Warranties

EXCEPT AS EXPRESSLY SET FORTH IN THIS LIMITED ENGINE WARRANTY, WE MAKE NO WARRANTY, EXPRESS OR IMPLIED, WRITTEN OR ORAL; AND THIS LIMITED ENGINE WARRANTY SHALL BE DEEMED TO BE IN LIEU OF ALL OTHER WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Exclusion of Damages

OUR LIABILITY IS LIMITED TO THE REPAIR OF REPLACEMENT OF OUR ENGINES OR ANY PARTS THEREOF WHICH PROVE DEFECTIVE UNDER NORMAL USE. WE SHALL NOT BE LIABLE FOR ANY DAMAGES, WHETHER INCIDENTAL, CONSEQUENTIAL OR OTHERWISE, WHICH MAY RESULT FROM ANY DEFECTIVE ENGINE.
